These Terms and Conditions (“Terms”) govern the roadside assistance, breakdown, towing, recovery and related services (“Services”) provided by Breakdown.lk (“we”, “us”, “our”) to you, the customer (“you”). By requesting or accepting our Services — by phone, WhatsApp, our website contact form, or in person — you agree to these Terms. Please read them carefully.
1. Who we are
Breakdown.lk is a 24-hour mobile roadside assistance and vehicle recovery service operating across Sri Lanka, based in Pannipitiya. You can reach us on 071 350 5087 or via WhatsApp on the same number.
2. Our Services
We provide roadside assistance and recovery services which may include, without limitation: jump-starts, flat tyre assistance, emergency fuel delivery, vehicle lockout assistance, towing, flatbed and winch recovery, car and vehicle transport, and on-site minor fault diagnosis. The specific service provided depends on your vehicle, the fault, and the situation on arrival.
We will make reasonable efforts to reach you within the estimated arrival time given at the point of dispatch. Arrival times are estimates only and may be affected by traffic, weather, distance, road conditions and demand. We do not guarantee a specific arrival time and are not liable for delays outside our reasonable control.
3. Quotes and pricing
We do not publish fixed prices because the cost of a job depends on your location, vehicle, the nature of the fault, distance and the equipment required. Before we dispatch a crew, we will provide you with a quote based on the information you give us. This quote is given in good faith on the basis of that information.
If, on arrival, the actual job differs materially from what was described (for example, the vehicle is in a different condition, location, or requires additional equipment or recovery rather than a roadside fix), we will inform you and, where possible, agree a revised price with you before proceeding. You are under no obligation to proceed if you do not accept the revised price.
If we attend and, through no fault of ours, are unable to help — for example the vehicle requires specialist workshop repair we cannot perform on site — we will tell you clearly. We do not charge a call-out fee where we are genuinely unable to provide any assistance, though this does not apply where a service has been partially or fully performed, or where you decline a reasonable service or revised quote after we have travelled to you.
4. Payment
Payment is due on completion of the Service unless otherwise agreed in advance. We accept cash, and bank transfer or online payment. Where payment is by bank transfer or online, the Service is considered settled once funds are confirmed received. We will provide payment details at the time. Please retain your own record of any transfer.
Prices quoted are inclusive of applicable taxes unless stated otherwise. Any additional services requested and agreed during the job may be charged in addition to the original quote.
5. Your responsibilities
You agree to:
- Provide accurate information about your location, vehicle and the fault when you request Service;
- Confirm that you are the owner of the vehicle, or are authorised by the owner to request Service and to authorise any towing, recovery or work on it;
- Be present (or ensure an authorised person is present) at the vehicle when our crew arrives, unless otherwise agreed;
- Ensure the vehicle is legally owned, insured and roadworthy to the extent required by law, and disclose any known hazards (for example, a modified vehicle, a leaking fuel tank, or hazardous cargo);
- Remove or secure any valuables and personal belongings; we are not responsible for items left in a vehicle;
- Follow the reasonable safety instructions of our crew at the scene.
You confirm that by requesting recovery or towing you authorise us to move and transport the vehicle to the agreed destination.
6. Liability
We take reasonable care in providing our Services and our crews use methods appropriate to your vehicle. However, to the fullest extent permitted by law:
- We are not liable for pre-existing faults, damage or wear, or for faults that develop or become apparent as a result of the underlying breakdown itself;
- We are not liable for damage arising from inaccurate or incomplete information you provide, from undisclosed vehicle conditions or modifications, or from the vehicle’s existing mechanical or structural condition;
- We are not liable for any indirect, incidental or consequential loss, including but not limited to loss of income, missed appointments, or onward travel and accommodation costs;
- Our total liability for any claim arising from a Service is limited, to the extent permitted by law, to the amount paid by you for that Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded under the laws of Sri Lanka. Your statutory rights as a consumer are not affected.
Any claim relating to alleged damage caused during a Service must be raised with us at the scene where possible, and in any case notified to us in writing within 48 hours of the Service, with reasonable supporting detail, so that we have a fair opportunity to inspect and investigate.
7. Insurance
You remain responsible for ensuring your own vehicle insurance is valid. Our attendance or recovery of your vehicle does not transfer any insurance responsibility to us. Where a job involves an insurance claim of yours, any dealings with your insurer remain between you and them.
8. Cancellation
You may cancel a request before our crew is dispatched at no charge. If you cancel after a crew has been dispatched and is en route or has arrived, we reserve the right to charge a reasonable amount reflecting the travel and time incurred. We will tell you if such a charge applies.
9. Safety and refusal of service
The safety of our crew, you, and other road users comes first. We may decline or discontinue a Service where we reasonably consider it unsafe, unlawful, or beyond the scope of what we can safely perform — for example, an unsafe roadside position, a vehicle carrying hazardous material, or where a person at the scene is abusive or threatening.
10. Third-party fulfilment
In some cases we may arrange for a trusted partner to fulfil part of a Service (for example specialist recovery). Where we do, we will act in good faith in selecting a suitable partner, but the direct service relationship and these Terms continue to apply between you and us for the job we arranged.
11. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the time you request a Service is the version that applies to that Service.
12. Governing law
These Terms are governed by the laws of Sri Lanka, and any disputes are subject to the jurisdiction of the courts of Sri Lanka.
